Marketplace Terms & Conditions

1. About These Terms

These Terms and Conditions ("Terms") govern your use of the Staff Track Marketplace ("the Platform"), a service operated by Staff Track ("Staff Track", "we", "us", "our"). By accessing or using the Platform — whether as a job poster ("Poster") or as a registered tradesperson or trade business ("Tradesperson") — you agree to be bound by these Terms in their entirety.

These Terms apply globally. Where local laws impose additional obligations or restrictions, those laws apply alongside these Terms. Nothing in these Terms limits any rights you may have under applicable consumer protection or other mandatory local legislation.

If you do not agree to these Terms, you must not use the Platform.

2. Nature of the Platform — We Are an Intermediary

Staff Track is a technology platform that connects Posters with Tradesperson. We are not a party to any contract, agreement, or arrangement entered into between a Poster and a Tradesperson.

Specifically:

  • We do not employ, endorse, certify, or guarantee any Tradesperson listed on the Platform.
  • We do not supervise, direct, or control the work carried out by any Tradesperson.
  • We do not guarantee the quality, safety, legality, or timely completion of any work.
  • We do not act as agent for either party in connection with any job.
  • Any contract for work is formed directly between the Poster and the Tradesperson. Staff Track is not a party to that contract.

Our role is limited to: (a) facilitating introductions between Posters and Tradesperson; (b) processing platform fees; and (c) providing the infrastructure through which parties may communicate and transact.

3. Eligibility

You must be at least 18 years of age to use the Platform. By registering, you confirm that:

  • You have the legal capacity to enter into binding agreements;
  • All information you provide is accurate, current, and complete;
  • You will maintain and promptly update your account information as required;
  • If registering as a Tradesperson on behalf of a business, you have authority to bind that business to these Terms.

4. Platform Fees

4.1 Listing Fee. Posters pay a non-refundable listing fee to publish a job on the Platform. This fee covers the cost of distributing the job to nearby Tradesperson and maintaining the Platform infrastructure. The listing fee is due before a job is published and is non-refundable once paid, regardless of whether quotes are received or a Tradesperson is engaged.

4.2 Emergency Listing Surcharge. Jobs marked as emergency attract an additional surcharge. By marking a job as emergency, the Poster confirms that the nature of the work is genuinely urgent. Misuse of the emergency flag may result in account suspension.

4.3 Contact Release Fee. Once a Poster accepts a Tradesperson's quote, a contact release fee becomes payable by the Tradesperson before full contact details are exchanged. This fee is non-refundable once contact details have been released.

4.4 Fee Changes. We reserve the right to change Platform fees at any time with reasonable notice. Changes will not affect fees already paid.

4.5 Taxes. All fees are inclusive of applicable taxes (including VAT, GST, or equivalent) unless stated otherwise. You are responsible for any taxes applicable to your use of the Platform in your jurisdiction.

5. Poster Obligations

As a Poster, you agree to:

  • Provide accurate, honest, and complete descriptions of the work required;
  • Respond promptly to quotes and communications from Tradesperson;
  • Agree a price, scope of work, and timeline directly with your chosen Tradesperson before work commences;
  • Pay the agreed price to the Tradesperson in full and on the agreed terms. Failure to pay a Tradesperson for work completed in accordance with your agreement is a serious breach of these Terms and may result in suspension or permanent removal from the Platform;
  • Not use contact details obtained through the Platform to circumvent Platform fees in future transactions with the same Tradesperson;
  • Leave honest, accurate reviews based solely on your genuine experience;
  • Not post jobs that are illegal, fraudulent, or in breach of any applicable law.

6. Tradesperson Obligations

As a Tradesperson, you agree to:

  • Hold all licences, permits, certifications, and insurance required by applicable law to carry out the work you quote for;
  • Provide accurate information about your qualifications, experience, and business;
  • Submit honest, transparent quotes and honour any quote you submit unless explicitly withdrawn before acceptance;
  • Complete work to a professional standard, within the agreed timeframe, and in accordance with the agreement reached with the Poster. Abandoning or failing to complete agreed work without reasonable cause is a serious breach of these Terms and may result in suspension or permanent removal from the Platform;
  • Communicate promptly and professionally with Posters at all times;
  • Comply with all applicable health and safety, building, electrical, gas, or other regulatory requirements relevant to your trade;
  • Not contact Posters for any purpose other than the job for which contact details were released.

7. Payment Between Posters and Tradesperson

7.1 Direct Arrangement. Payment for work carried out is a matter solely between the Poster and the Tradesperson. Staff Track does not hold, process, or guarantee payment for work performed.

7.2 Written Agreement. We strongly recommend that Posters and Tradesperson agree in writing (including by message or email) on: the scope of work; the total price or day rate; payment milestones (if applicable); and the timeline for completion, before any work begins.

7.3 Non-Payment Consequences. A Poster who fails to pay a Tradesperson for completed work may be reported to Staff Track. Upon investigation, we may suspend or permanently ban the Poster's account, publish a record of the dispute, and refer the matter to any relevant regulatory authority. We reserve the right to share relevant information with the affected Tradesperson to assist them in pursuing payment through appropriate legal channels.

7.4 Incomplete Work. A Tradesperson who fails to complete agreed work without good cause may be reported to Staff Track. Upon investigation, we may remove the Tradesperson's profile, suspend or permanently ban their account, and notify other Posters who have engaged or are in the process of engaging them.

7.5 Dispute Resolution. In the event of a dispute between a Poster and a Tradesperson, we encourage both parties to attempt resolution directly. Staff Track may, at its sole discretion, offer guidance or mediation but is under no obligation to do so and assumes no liability for the outcome of any dispute.

8. Deterrents and Enforcement

To protect the integrity of the Platform and all users, Staff Track operates the following deterrent measures:

  • Review System. All completed jobs are subject to mutual review. Reviews are visible to all users of the Platform. Dishonest, retaliatory, or fraudulent reviews are prohibited and may be removed.
  • Verification Badges. Tradesperson may upload trade licences and insurance certificates. Failure to maintain valid documentation may result in removal of verification badges and reduced visibility on the Platform.
  • Reporting Mechanism. Both Posters and Tradesperson may report misconduct. All reports are reviewed by Staff Track. Repeated or serious misconduct will result in account suspension or permanent ban.
  • Account History. Staff Track maintains records of all Platform activity. A history of disputes, non-payment, or incomplete work will affect a user's standing on the Platform.
  • Legal Referral. In cases of fraud, deliberate non-payment, or criminal conduct, Staff Track reserves the right to refer matters to the appropriate law enforcement or regulatory authority.

9. Prohibited Conduct

The following conduct is strictly prohibited on the Platform:

  • Posting false, misleading, or fraudulent job listings or quotes;
  • Impersonating any person, business, or organisation;
  • Using the Platform to facilitate any illegal activity;
  • Harassing, threatening, or abusing any other user;
  • Attempting to bypass Platform fees by arranging repeat jobs with a connected party outside the Platform;
  • Posting spam, unsolicited advertising, or irrelevant content;
  • Attempting to compromise the security or integrity of the Platform.

Violation of these prohibitions may result in immediate account suspension or termination, without refund of any fees paid.

10. Verification and Insurance

Staff Track may offer optional document verification for Tradesperson, including trade licences, public liability insurance, and employer's liability insurance. Where such documents are uploaded:

  • Staff Track does not independently verify the authenticity of documents beyond automated scanning;
  • A verification badge indicates only that a document was uploaded and passed basic format checks — it is not a guarantee of authenticity or validity;
  • It is the Poster's responsibility to satisfy themselves as to a Tradesperson's qualifications and insurance before engaging them;
  • Tradesperson are solely responsible for maintaining valid insurance and licences at all times while operating on the Platform.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Staff Track is not liable for any loss, damage, injury, or expense arising from work carried out (or not carried out) by any Tradesperson;
  • Staff Track is not liable for any failure by a Poster to pay a Tradesperson or by a Tradesperson to complete work;
  • Staff Track is not liable for any indirect, consequential, special, or punitive damages arising from use of the Platform;
  • Our total liability to you for any cause whatsoever shall not exceed the total Platform fees paid by you in the 12 months preceding the claim.

Nothing in these Terms limits liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

12. Intellectual Property

All content, branding, software, and technology on the Platform is owned by or licensed to Staff Track and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the Platform without our prior written consent.

By posting content on the Platform (including job descriptions, photos, and videos), you grant Staff Track a non-exclusive, worldwide, royalty-free licence to use, display, and distribute that content solely for the purpose of operating the Platform.

13. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We process personal data in accordance with applicable data protection law, including the GDPR where applicable.

Contact details exchanged through the Platform (including phone numbers and addresses released upon payment of the contact release fee) may only be used for the purpose of the specific job in connection with which they were released.

14. Termination

We may suspend or terminate your access to the Platform at any time if you breach these Terms, engage in conduct detrimental to other users or the Platform, or for any other reason at our discretion, with or without notice.

You may close your account at any time by contacting us at admin@staff-track.com. Termination does not entitle you to a refund of any fees already paid.

15. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes by email or by prominent notice on the Platform. Continued use of the Platform after changes take effect constitutes your acceptance of the updated Terms.

16. Governing Law and Disputes

These Terms are governed by the laws of Ireland. However, where you are resident in another jurisdiction, mandatory consumer protection laws of that jurisdiction may also apply.

Any dispute arising out of or in connection with these Terms that cannot be resolved between the parties shall be referred to the courts of Ireland, without prejudice to your right to bring proceedings in your local courts where required by applicable law.
